Just hold on to those papers and make them available when they travel back in future.

I had F1 visa from July 2002 - July 2007 stamped in my passport. I moved to H1b in Oct 2004 and stamped my H1 Visa in June 2005. So you can move to H1B from F1 without stamping any visa only if you have to leave US then you need to get the new H1 stamp before re-entering. Also do not forget to fax a caopy of your H1 approval notice to your school's international center so that they can stop reporting you in SEVIS

Besides, depending upon how the "CLASS" is defined- you will not lose your claim if they win the lawsuit.
It does not require you to have filed your case to benefit from the class action , but it depends on how the class has been defined. You can goto Rajiv's website and hear the latest conference call recording which explains his opinion on this.

IM just tring to find out if any one in EB3 cat. are seening any movement or progress by USCIS.
I have a pd of APR 2001 but no progress or lud in the past 1 year
nothing on my file and when i call USCIS they send me a letter saying
still in our prossesing time, but my app date of may 2004 with a approved
i-140
and still waiting for 485 .
I am surprised why you still didn't received GC approval yet...sorry for you dude..keep hope..
Take Infopass,call CIS weekly,talk to any senator about your case and be on it..for justice..
Your 485 receipt date is May 2004?? Did you stuck in namecheck?? If so they might be working on clearing those NC victims soon..
BTW,Are you with same GC sponsored employer till date??

It seems my company had audit and my employer was asked to submit client letters for all employees.
Q's is will it have any impact on 485 process for the employees in case of any issues in the company in other areas ?

My wife has H4 stamped and valid till Nov 2008 but from Oct 2007 she changed her status to H1B. She has I797. My question is when she goes to India does she need to stamp H1 B or she can reenter on already stamped H4 ?

Hi,
I need suggestion on travel.
I have applied AP for my wife on April 16 and still waiting. We have expiated her AP last week, still no updates. She has an emergency travel on June 20th. Her previous AP is valid till June 24th.
Can she travel out side on June 20th and come back with new AP when approved (I can mail her the new one once approved) or dose she needs to be in US until the new AP is approved?
As the old AP is valid till June 24th, dost it mean that they will approve the new one only after June 24th?
As this is an emergency I need your suggestion please...

Yes you would need a transit visa. In fact in Air India (not sure about other airlines) without transit visa you cannot even board the plane from US

All,
I had posted some queries previously and thanks to all who took time to respond.
As I had said before , I have an admission to study for my MBA outside US for one year. Here is the latest update:
I was thinking I will get a one year leave abscence from my employer ( advt on the website), but apparently they dont support studies as part of the deal.
So i am out of luck;
Considering my situation what do you gurus recommend.
How can I leave US yet maintain my GC process.
My I-140 is approved
Situation:
Spouse in school Full time Studies on I-485 pending. ( entered on F1 then converted to I485..... so going back to F1 is impossible)..
I want her status to be preserved.
My thought:
Resign from my company when I need to leave. Convince them that I will return. Maintain no ties with the company for one year..basically can be compared to being jobless for one year.
and then get a letter that a future similar job will be available with the same Co. ( that sponsored my GC)...
Is this feasible ./practical?

I live and work in the state which is under jurisdiction of TSC. I got my PERM approval from Atlanta National Processing Center. But for some weird reason, my attorney has mailed my I-140 & I-485 documents to NSC and it reached there today(07/27/07). My understanding is that my applications should have been sent to TSC directly. I am kind of worried now as my application has reached the wrong service center. Has anyone encountered a similar situation? Is there anything I could do now to address this issue? Even if NSC internally transfers the documents to TSC, will my receipt date be considered as the date they received at NSC? Is there any directive or memo from USCIS regarding this issue? Please advise.

Did you have a receipt number for 140? I'm in the same boat but I didn't apply for 485 yet. and I don't have a 140 receipt number.

Finterpring while H1 stamping is different. You need to get finterpring again when you apply for I485. They took my fingerprinting when I went for H1 stamping(though it was couple of years ago), but gave finger printing again after applying for 485.
So better you contact USCIS. Search in IV forums, I read sometime back that there are some people who didnt get fingerprinting notice.
