Many people wait until they at least receive the receipt notice but nothing stops you from starting with the new employer as soon as the petition is submitted (you may need to provide proof of this submission) as per AC21.

Company B applied H1B tranfer petition for me two weeks back. Our documents went to USCIS, and we didnt received receipt notice yet. To my surprise the filing fee check is also not yet encashed.
Can anyone of you please let me know, if I can start working with company B now or wait until we get the receipt notice. What is the USCIS guidelines with the start date during H1B transfer.

You are so fortunate. My priority date is May 2006, but my I-140 was only approved & received by NVC last January. We have similar question. I hope the statement from the FAQ of NVC (check http://travel.state.gov/visa/immigrants/types/types_1309.html) will help us.

There is a policy for accepting asylees from Cuba and allowing them to seek permenant residency.

The wet feet, dry feet policy (sometimes called the wet-foot, dry-foot Policy) is the name given to a consequence of the 1995 revision of the Cuban Adjustment Act of 1966 that says, essentially, that anyone who fled Cuba and got into the United States would be allowed to pursue residency a year later. After talks with the Cuban government, the Clinton administration came to an agreement with Cuba that it would stop admitting people found at sea. Since then, in what has become known as the "wet feet, dry feet" policy, a Cuban caught on the waters between the two nations, "wet feet", would summarily be sent home or to a third country. One who makes it to shore, "dry feet", gets a chance to remain in the United States, and later would qualify for U.S. citizenship.
You better carry a nice towel with you when you come back from Cuba and make sure your feet are dry when apprehended by coast guard. And make sure you dont end up getting kidnapped and killed in Cuba, coz they really dont have very nice law enforcement.

Now I just saw people on this forum with PD Aug 2003 got approved 10/17.
and I know a friend with pd oct 2003 got approved in April.
Suppose that the guy got approved 10/17 was input to the system after the other luckier guy, the most conservative estimation is now pd Aug 2003 is being processed.
Anybody heard of any later PD being approved recently? from DBEC?
I'm just thinking, if we share the pd/approval information on this forum we'll have better estimates about our cases and have a somewhat less stressful life.

Folks:
I had a Biometrics/FP appointment today @ 8:00 AM at the San Antonio
Application Service Center. I showed up at 7:58 AM. At 8:00 AM, a
staff member opened the door and yelled out that people with 8:00 and
9:00 AM appointments should step forward and a lot of people in the
line raced to the front. I did not.
I got in at 8:03 AM and was handed an information sheet to be filled
out. 8:08 AM, I was done completing the data sheet. At 8:10 AM, I went
to get my token and the service rep looked at the Drivers License
photo and my photo and told me that I don't look like "sw33t".
Luckily, I had my passport with me and he inspected my fingers after
which he gave me a token and waved me through.
I didn't even have to sit and the FP service agent called out my token
number and I went straight in.
8:11 AM - This was the process -
a. Left hand - all four fingers
b. Left hand - thumb
c. Right hand - all four fingers
d. Right hand - thumb
e. Left hand - Each individual finger starting off with the thumb.
f. Right hand - Each individual finer starting off with the thumb.
He stamped my application with the QC stamp, asked me about the
service and filled out the service report card on his own and asked me
to drop it off at the box.
I came out and went straight to my car and checked the time on my cell
phone - 8:16 AM.
18 minutes - I think I set a new record.
HTH. I haven't checked to see if the LUD was updated.

Not that I know ... the worst case scenario is that your green cards are physically mailed to you and then they are returned 'cause nobody was at the home (though normally, it should just sit with your other mail).
When you reenter US, stand in the regular visitor line.... if your card is issued, the IO will know and stamp your passport w temporary green card and allow you in the US.

We are extremely excited to announce that some other senators we were in touch with, have introduced amendments in favor of legal skilled immigrants. We will reveal details pretty soon.
Before anyone thinks about posting that the bill is dead, we have some news for you! It is not. There is too much noise right now and the undocumented folks doing rallies with 100K people at one time, this will not be pushed under the rug. Also, we have heard whispers in DC that the immigration bill will be taken up pretty soon after the recess :)

I am currently on H4 and it expires in a couple of months. I have my H1 approved for 2008 quota. My husband's H1 expires on sept 2007. we are applying for I-485 next month. Do i need to apply I-765 and I-131 because as per the instructions from my attorney it says the following:
-I-765 or EAD card. If you have valid H-1B valid more than one year and will not change job, you do not need EAD.
-i-131 or Advance Parole. If you have valid H-1 or H-4 visa stamping valid more than one year of if you are Canadian citizen, you do not need AP
Please clarify me whether I-765 and I-131 is required for our case.

Gurus,
I have labor pending from a State A, now my employer is asking me to move to State B. However, my employer is willing to keep alive, labor process from State A and is also ready to file new labor from State B. Question is if labor A gets approved and if I apply I-140 on that labor, do I have to reapply I-140 for labor B, once labor B gets approved or I can use the same I-140?
Help is appreciated.

Whether it is LCA for H1 or PERM labor for GC it is location specific, unless one filed(or able to file) AC21 after July '07 fiasco, you need to have labor to a specific job to the specific location you will be working.
Either job or the location changes you need to start allover again, in some cases you can recapture (or port) your priority date.

Sorry to hear about your situation. You are out of status the minuet you lost your job and the 180 days clock has already started ticking i.e. out of status for more then 180 days and still in the country may result in 5 yr entry ban.
I don't want to scare you but just sharing the law details.
Now you best course of action would be to get a job ASAP and get your H1 transferred. For this process immigration will ask for your last pay stub and if there is a big gap then they might reject your visa but again it is hard to say anything as it totally depends upon the officer.
Also, hire a good attorney if you can.
Staying in the US after losing a job on H1 is a gray area, especially when you have a valid i-94 hence getting a good attorney is very important.
Also, you might want to look at student visa or visitor visa to maintain your legal status.

You are not alone. I will be joining the same pool. In fact, I have already served a notice and would be leaving this company of mine on the same day on which I will be flying to India. I do not know if there will be any issues of it while coming back on AP but I would have already passed 180 days well before it.
