Technically, you can do that. But it's better for you to transer your case to consular processing if you are not planning to be in the US for a couple years.
I forget to mention that it is for my wife. she is my dependent with EAD and AP. i know if she have green card she have to stay 6 months in usa. it that applies to EAD and AP also.

I'm possibly in the same situation - if the company I work for gets bought and the company name changes does this complicate the process? I would hold the same job, title and everything else? This is a real possibility we already made 1/3 of the workforce redundant last week..
Or is it that the name change or the going away of the oirginal sponsor name means a re-start to the PERM stage? This is bad timing for me as I'm about to enter my 6th year of H1B - and as I understand it I cannot start a new PERM in the last year of H1B..?
What should I do - hold my breath or can I do something in the 3 months I have left before my 6th year starts??

Can any of you throw some light on these
To my understanding, if one is maxing out 6 years of H-1B visa on Nov 30, 2009 and doesn't have a way of extending to the 7th year H-1B.Then he has to stay physically outside of USA for 1 year.
1.Does 1 year stay have to be in the home country only?
2.Can one come and visit USA for a month[June 2010] or so between Nov30,09 and Nov 30,2010.[Eg: Conference, interview]?
3.If answer is yes to 2, would one have to stay for another 1 year away from July 2010? or they can come back to US during Dec 2010, if they have a new H-1B job?
Inputs appreciated.

As long as your Advance parole is not expired, you should be able to travel with it. If your Advance parole is going to expire around the time you are planning travel; you should renew your advance parole.

As I understand the process, if your date is current, the USCIS will accept your application - meaning they ARE processing applications with a priority date matching or exceeding yours.
During the July 2007 fiasco, the cut-off dates were current, allowing everyone to apply. If we submitted our application and the date is current at the time, why do we have to wait until our date becomes current again? Shouldn't they process the application within 6 months or less?

If someone using company lawyer to file I-485 and other forms, ask this lawyer will he send receipt notices to the applicant or not. Some will get answer that it's company policy not to sent anything to applicants :mad: .

The primary question among immigrants, immigrant advocates, and anyone else interested in immigration reform is whether the president and congress will attempt to address comprehensive immigration reform this year. President Barack Obama on Thursday assured frustrated supporters of a promised overhaul of U.S. immigration laws that he remains committed to fixing a system he says is broken.
What remains unclear is whether Congress will send him a bill this year.
Obama said he told the senators and the advocacy groups that "my commitment to comprehensive immigration reform is unwavering, and that I will continue to be their partner in this important effort."
The immigration issue is an important one for Obama, who has promised to work to solve problems. Hispanics voted heavily for Obama in the 2008 presidential election, making the difference in key states like Florida, and their votes will be critical in the November midterm elections. Latino voters who don't think progress is being made on the issue may not go to the polls.
After meeting for more than an hour with Obama, immigration advocates told reporters they want Schumer and Graham to at least release their blueprint before a planned March 21 demonstration at the Capitol, with a bill introduced in the Senate soon after.

I recently found out that someone had stolen my credit card information to purchase items online. I have since then closed that credit card and went ahead and put a fraud alert for 90 days on my credit report. I don't believe my SSN was stolen, but I want to check my credit report and also for protection have the alert so that no one tries to apply for loans etc. using any of my information.
Will having the fraud alert have an impact on my 485 filing in any way? Let me know what the best process is to handle this if it does have an impact on 485 background checks, and pending green card approvals etc.
I have no criminal history.

Fraud alert does not go into your permanent credit report. All this does it is that when you try to open a new loan/credit account, the lender will see that there is a fraud alert on your profile and may call you to verify. It should not have any effect on your I-485.

I am from Pakistan and I do have Canadian PR also. I applied I-824 on August 5, 2008 and it got approved very fast on January 16, 2008 IN just 5 and half months and I have written that I want to process my case in Toronto Canada not from Pakistan now I have the following question
1-on approval notice the petitioner name and the beneficiary name is the same don�t u guys thing the beneficiary name should be my wife name
2-DO all FTJ cases are processed through NVC. Or only some of them... because Islambad embassy accept cases from NVC only they told me that I-824 has to be approved and then UCIS will send your case to NVC and then case will be sent to islamabad but is this the same procedure for canada because I-824 approval notice says that they have notified tornto consulate that I am the permenant resident thats all. I 824 do not have even my wife name?? Can any body tell me clearly that does every body who files I-824 has to go through NVC or in case of Canada we can go to consulate and start the case?
3-If NVC is involved in my case then how long file will stay at NVC and how long the consulate in Toronto will take to complete the process.

It seems that H-1B petitions (http://www.h1b.biz/lawyer-attorney-1137085.html) for Speech Language Pathologists (SLP) and similar related occupations are being closely monitored to ensure that accurate job duties are being identified to confirm CGFNS (Commission on Graduates of Foreign Nursing Schools) certification requirements.
There are multiple progressive occupations within the Speech Language Pathology career field including, Teachers of Speech and Hearing Handicapped (TSHH), Teachers of Speech and Language Disabilities (TSSLC), Speech Language Pathologist Assistants (SLPA) and Clinical Fellows (CFY), and Speech Language Pathologists (SLP).
While all of these positions require a state license, only SLPs who are certified by the American Speech-Language-Hearing Association (ASHA) may provide direct patient care without supervision, and thus, only certified SLPs require CGFNS certification.
According to CGFNS, the other related occupations (TSHH, TSSLC, SLPA, and CFY, all of which require a minimum of a bachelor's degree, a license, and direct supervision by a licensed SLP) do not provide independent patient care and must be supervised by a licensed SLP and, therefore, are not eligible for CGFNS certification.
USCIS officers ask that H petitioners carefully delineate the job duties of positions within this career field so that officers can determine whether the position is one of the SLP related occupations that do not require CGFNS certification.
