Hi everyone!
I had a question about receiving updates in the mail and checking the case status online. This is for my Marriage-based GC interview at the San Francisco office. My service center is Missouri MSC.
I had my interview for marriage based GC on May 27th. The interview was short and went very well. The IO said that everything was in order, though I needed to have my dr resend USCIS my medical reports again as the dr had missed some fields on the medical form. The IO said many dr's were missing some fields on the recently updated forms. The IO then gave me a form which said that I needed the medical examination resent and which also had the "Further review" box checked. The IO said I should get something in the mail within 10 days of USCIS getting the new medical report.
I immediately went and had my dr resend the medical report with everything filled out. The USCIS acknowledged the receipt of the new fully filled medical form on June 2nd.
It is June 18th today and I have not received anything in the mail yet. The online USCIS case tracker hasn't been updated in months and still shows my case as having been on the "Accepted on March 17th" stage, even though I've already done the finger printing and the interview. Calling the 1-800 number for status updates says the same thing, that I applied on March 17th and that a letter was mailed to me regarding finger printing.
Do you know why I haven't gotten anything in the mail yet, or why the online status tracker hasn't updated at all? I wonder if this is a bad thing, a normal thing, or if the San Francisco field office [or the Missouri Process Center MSC] is taking longer than usual to send out mails after the interviews?

It's taking anywhere between 4 to 6 weeks on an average after the introduction of the new lockbox system. We received our receipts in 29 days, so I don't think you should panic yet :)

Initially I came to USA on H1B in May 2002 and stayed till June end 2004. In early 2004 I had applied for H1B extension and got it extended till Sep 2005. As I went back to India in July 2004 I didn't get a chance to extend my H1B for the second time. Effectively I
was in USA for just over 2 years on H1B and overall validity of my H1B was over 3 years.
Last year (2007) July I came to USA on L1A and I have the visa valid till March 2010.

Can someone suggest whether he can apply for H1 Transfer and Extension or does he need to apply for new H1B in the 2008 quota?

Yes its related to property matters and need to execute on a stamp paper from India, I see below from Indian Consulate, San Francisco website
"If you are obliged to execute the Power of Attorney on a Stamp Paper from India, then please follow the �Apostille� Convention. Once the �Apostille� sticker is affixed to the Power of Attorney, the Consulate is not required to authenticate again the Power of Attorney."

Today I got CODE 1 FP notice, is this a positive sign?
I requested(May 02nd) USCIS to approve my case using "Cross-Chargeability", since my wife was born in non-retro country. But from June 01st, my PD (India) also becomes current.

Since USCIS started I-140 premium processing service on 06/29/09, you can try and upgrade your pending I-140 to premium processing so you can get a decision on your case within 15 days...When you get your I-140 approval, you can file for a 3 yr H1 extension based on it.

I have got this response from Congressional Liaison, when I asked them for Update on my case whether I have to wiat till Oct or not based on the recent update on visa bulletin.
They Sent me This Email:
Your I-485 received on 5/21/07 and the Southern Service Center(TSC) is working these types of applications filed 9/11/06. They received your biometrics from the ASC 6/13/07 and the case has been assigned to an Adjudicating Officer for review. But, by the processing times, you still has a little time to wait.
Couple of question: They received your biometrics from the ASC 6/13/07 : Is this mean my FBI and Name Check cleared : I did my FP on same day?

Hi,
I got a contract offer at company A (Industry: Health) at a big city. Currently I am working for a State Government as a contractor. As per salary is concerned not much of a difference between the two contract positions. Me and and my wife are currently working but at different places. 2-3 months back we thought of moving to a big place so that the probability of the other person getting job would be more and we can stay together at the same place so I applied for Company A. They accepted my resume but because of the economy and budget constraints they hold the position and after sometime I forgot about it. I dropped the idea of moving and didn't apply for any jobs because of the current economy situations. Now last week after more than 2 months they reopened that position and interviewed me and I got the offer yesterday. Now I am in a dilemma whether to take this offer at Company A or stay where I am until the economy goes little better. My current job is stable. Added to that my wife's contract getting over in Jan 2009. I am cracking my head here thinking what's right thing to do.
Scenarios:
1. If I moved to Company A and my job is good and then after Jan my wife can look for a job at that place. (chances are more because of Big City). Everything is good.
2. If I moved to Company A and crisis is soo bad and I lost my job and from jan my wife contract is ending. After that it's just nightmare.
3. If I stay where I am and once the economy stabilizes atleast a bit and look for a job.
I really appreciate your suggestions. I know they are people in our forum who studied current economy so good and can give me a valuable advice. Thanks.

My Company applied PERM in Sept'07 at Chicago. Till now company hasn't heard back yet and now employer is planning to file one more PERM appl. through different Lawyer. Can we file one more application without hearing/know the first case status?

My friend and his wife 485, EAD and AP applications are pending. Do they need to send 1 AR-11 for each pending forms (totally 6 AR-11s)? There is no place to put all pending LIN number in the AR-11. We can put only A#. How does it work? Please reply.

Hello All,
I am in a very sticky situation, my labor is pending @ PBEC with priority date of Jan'2004, which is Non-RIR and filed under EB3 category, based on which I have been getting incremental extensions of H1B (I am already in my 9th year by now). At present I am in the process of changing my filing type to RIR from TR and I was hoping to change the category too from EB3 to EB2, but my employers did not support me since they cannot pay the prevailing wage. I know I can still switch jobs, provided I transfer my H1B (which is valid till Jan�2008) and the new company files my GC immediately, so my questions to fellow victims of PBEC is
� How can I retain my old priority date?,
� Does the job descriptions filed with old labor have to match with job descriptions filed in PERM?
� It will be very tough, since I have almost 12+ yrs of exp in the industry, but my present employer is taking advantage of my situation and he is paying me peanuts, just because he does not want to pay me more, they have filed the papers as EB3. So while filing labor under EB2, can I still maintain my old priority date.
Please guys/gals help me out, I am not sure what to do, since I have already spent almost 3K$ on my GC and If I will be stuck with my employer at such low salary after my labor & I140 gets approved because of the retrogression it will be disaster. So I was thinking it would be better to be stuck with employer, who at least pays me decently and if I can retain my old dates it will awesome.

Just make the switch,,thats it! Its that simple!! Make sure when u join the new company they file your perm asap and when u r in the 140 stage, you could work with your lawyer to port your old PD. AC21 has made life better!
There are two ways :-
a) Get your H1 transferred and join a new company. You need to complete your new PERM and I-140 before Mar'08 to get your next extension. In this case, you cannot carry over your PD.
b) Wait for your I-140 to be approved. Once it is there, move on, and file your PERM/I-140. You should be able to get your next extension based on the approved I-140 unless it is revoked. Also, you can start your PERM in parallel while waiting for I-140. You can speed up your I-140 by moving it to PREMIUM processing - it involves another 1000 $ of cost. This way you can carry on your PD if you can get a copy of the I-140 when you leave.
